Meeting with the UN Special Rapporteur

The head of CADAL, Gabriel Salvia, held a meeting with Mutuma Ruteere, Special Rapporteur on contemporary forms of racism, racial discrimination, xenophobia and related intolerance, who was on an official visit to Argentina. The meeting was attended by representatives of Congreso Judío Latinoamericano, DAIA, AMIA, Centro Simon Wiesenthal, Museo del Holocausto and Bnai Brith.

The call to meet with Mr. Ruteere was made by the Secretary of the Office of the United Nations High Commissioner for Human Rights and was held at the headquarters of Congreso Judío Latinoamericano to promptly address the issue of anti-Semitism in Argentina.

CADAL was invited to the meeting because of the implementation of the project "Fight against Anti -Semitism and Promotion of Religious Tolerance" a project declared of interest by the legislature of the City of Buenos Aires.

Among those attending were the Director of Congreso Judío Latinoamericano, Claudio Epelman; the President of the DAIA, Ariel Cohen Saban; AMIA President, Tomas Saieg; Ariel Gelblung , representative of the Simon Wiesenthal Center; Gustavo Mehadeb Sakkal, President of the Holocaust Museum; Daniel Malamud, representative of Bnai Brith; and Judge Marcos Grabivker .

During his visit to the country, the Special Rapporteur recommended the evaluation of trends and manifestations of racism, racial discrimination and related intolerance in Argentina; the existing legal and institutional framework to protect vulnerable groups and combat such violations; information and analysis on the progress made by the State in this regard. Mr. Ruteree met with the executive, legislative and judicial authorities; civil society organizations, academics, people involved in the fight against racism and racial discrimination, as well as communities and victims of racism, racial discrimination, xenophobia and related intolerance .

The Special Rapporteur on contemporary forms of racism, racial discrimination, xenophobia and related intolerance is an independent human rights expert appointed by the United Nations Human Rights Council. Mr. Mutuma Ruteere was appointed Special Rapporteur on contemporary forms of racism, racial discrimination, xenophobia and related intolerance on November 2011. He also serves as Director of the Centre for Human Rights and Policy Studies, an independent research centre based in Nairobi, Kenya. He holds a doctorate in political science with a specialization in human rights.

The mandate was created in 1993 by the Commission on Human Rights by resolution 1993/20 . In 1995, the mandate was amended by resolution 1994/64 . On March 28, 2008, the Human Rights Council adopted resolution 7/34 by which the mandate of the Special Rapporteur was extended for an additional period of three years. In 2014, the Human Rights Council adopted

resolution 25/32 which extended the mandate of the Special Rapporteur for another period of three years, in accordance with the terms of reference contained in the resolution of the Human Rights Council 7/34 . Mr. Ruteere was granted a second three-year term in June 2014.

By the resolution of the Human Rights Council 7/34 the Special Rapporteur is required to focus on the following themes : a. Incidents of contemporary forms of racism and racial discrimination against Africans and people of African descent, Arabs, Asians and people of Asian descent, migrants, refugees, asylum seekers, minorities and indigenous peoples, as well as other victims spelled out in the Durban Declaration and Action Programme;

b.Situations where the persistent denial of their recognized human rights as persons belonging to different ethnic and racial groups, as a result of racial discrimination, this constitutes a serious and systematic violation of human rights; c . Acts of anti-Semitism, Christianophobia and Islamophobia in various parts of the world, and racial and violent movements based on racism and discriminatory ideas directed against Arab , African, Christian, Jewish and Muslim communities and others ;

d. Laws and policies glorifying all historic injustices and fueling contemporary forms of racism, racial discrimination, xenophobia and related intolerance, based on persistent and perpetual inequalities experienced by racial groups in various societies; e. The phenomenon of xenophobia; f. Best practices to eliminate of all forms and manifestations of racism, racial discrimination, xenophobia and related intolerance; g . Monitor the implementation of all relevant provisions of the Declaration and Durban Action Programme and promote the establishment of mechanisms at the national, regional and international level in order to combat racism, racial discrimination, xenophobia and related intolerance;

h . The importance of human rights education in promoting tolerance and the elimination of racism, racial discrimination, xenophobia and related intolerance; i . Respect for cultural diversity as a means to prevent racism, racial discrimination, xenophobia and related intolerance;

j . Incitement to all forms of hatred, as spelled out in paragraph 2 of Article 20 of the International Convention on Civil and Political Rights, and cases of incitement to racial hatred, including the dissemination of ideas based on racial superiority or that incite racial hatred, as stipulated in Article 4 of the International Convention on the Elimination of all Forms of Racial

Discrimination, Article 19 of the International Convention on Civil and Political Rights and General Observation No. 15 of the Committee on the Elimination of Racial Discrimination which provides that the prohibition of the dissemination of all ideas based on racial superiority or hatred is compatible with freedom of opinion and expression;

k . The increase in the number of political parties and movements, organizations and groups which use xenophobic platforms to incite hatred, considering the incompatibility of democracy with racism; l . The effects of some counter-terrorism measures vis-a-vis the rise of racism, racial discrimination, xenophobia and related intolerance, including the practice of racial profiling based on any grounds of discrimination prohibited by international human rights laws;

 

m . Institutional racism and racial discrimination; n . The efficiency of the measures implemented by governments to address the conditions of victims of racism, racial discrimination, xenophobia and related intolerance; o. Impunity for acts of racism , racial discrimination, xenophobia and related intolerance, and increased maximum reparations for victims of such abuses . In carrying out his mandate, the Special Rapporteur :

* sends urgent appeals and letters of allegations of complaints to States regarding cases of racism , racial discrimination, xenophobia and related intolerance; -Make Country visits and makes reports on such visits; -Presents Annual thematic reports to the Human Rights Council and the General Assembly on its activities, trends and methods of work . The mandate holders since 1993 have been : - Mutuma Ruteere ( Kenya ) , until November 2011; Githu Muigai ( Kenya ) , 2008-2011; Doudou Diène (Senegal ) , 2002-2008 ; and Glèlè - Ahanhanzo ( Benin ) 1993-2002 .
